Kenny Kim Landscaping provides landscaping, hardscaping, woodwork, and outdoor living space services in North York and the Greater Toronto Area (GTA). Our services are subject to availability and may vary based on project scope, client requirements, and local regulations.

2. Quotes and Contracts

• Estimates: Any estimates provided are based on the initial consultation and may be subject to change depending on project details, material availability, or unforeseen circumstances.
• Contracts: A signed contract is required before commencing work. The contract will outline project scope, payment terms, and deadlines.
• Amendments: Any changes to the agreed-upon contract must be communicated in writing and approved by both parties.

3. Client Responsibilities

• Access: The client is responsible for providing clear and safe access to the worksite.
• Utilities: The client must ensure that necessary utilities (e.g., water, electricity) are available for the duration of the project.
• Permits: The client is responsible for obtaining any required permits unless otherwise agreed upon in writing.

4. Payments

• Deposits: A deposit is required before work begins. The amount will be specified in the contract.
• Payment Schedule: Payments must be made according to the schedule outlined in the contract.
• Late Payments: Late payments may incur additional fees as outlined in the contract.
• Cancellations: Cancellation of services may result in forfeiture of the deposit and additional fees, depending on the stage of the project.

5. Warranties and Liability

• Workmanship: We guarantee the quality of our workmanship for a specified period, as detailed in your contract.
• Materials: We use high-quality materials sourced from reputable suppliers. Any defects in materials will be addressed based on the supplier’s warranty.
• Limitations: We are not responsible for damage caused by factors beyond our control, such as extreme weather, improper maintenance, or unauthorized modifications.

6. Termination

Either party may terminate the contract for valid reasons, including breach of terms or unforeseen circumstances. Termination must be communicated in writing. Any work completed prior to termination will be invoiced and must be paid in full.

8. Dispute Resolution

In the event of a dispute, both parties agree to attempt resolution through negotiation. If the dispute cannot be resolved amicably, it may be escalated to mediation or legal proceedings in Ontario, Canada.

We reserve the right to update these Terms at any time. Clients will be notified of significant changes.
